I would like to view the image with a front view

Current privacy laws in Italy prohibit frontal framing, therefore the system used is approved to frame only the data of the rear license plate of the vehicles that have allegedly committed the infringement.

The plate on the picture does not match the one on the fine received

I have exceeded the speed limit by a few km/h

The speed reported on the fine has already been reduced by 5% (with a minimum of 5 km/h) compared to the speed measured.

Amounts of penalties and points deduction
When is it possible to pay the amount with a 30% discount?

The reduced payment of 30% is calculated on the amount of the penalty only (and not on the total amount of the fine) and is foreseen for payments within 5 days as from the date of notification, as per Law Decree No. 69 of 2013, converted into Law No. 98 of August 9th.

Is the 30% reduction of the amount foreseen even if you request to pay by instalments?

No. If the request is accepted, the 30% reduction is not applied to the penalty to be paid in instalments.

I have a foreign driving license; do I have to provide the driver’s details?

We inform you that for penalties committed in Italy by holders of foreign driving licenses, the driver’s data are collected by the Ministry of Transport. If the driver loses 20 points in 6 months, he/she will be prevented from driving in Italy for 1 year. If the driver loses 20 points in 1 year, he/she will be prevented from driving in Italy for 6 months.

I have received a “Fine with Protocol No. XX00000000 …” pursuant to Article 126bis

According to the legislation, if you fail to communicate the driver’s data, the assessing authority will draft a fine on its own initiative (ex-officio), pursuant to Article 126 bis of the Traffic Code. The payment of this fine avoids the points deduction.

Does the payment of the “Protocol Report: XX00000000 …” pursuant to Article 126bis exempt the offender from the duty to communicate the driver’s data?

Yes. The payment of this fine exempts the offender from the duty to communicate the driver’s data, for the purpose of deducting license points.

I have received a fine for the infringement of art.142, paragraph 7. Do I have to communicate driver’s personal data?

No. With respect to this infringement, the legislation does not provide for points reduction, therefore it is not necessary to fill in the form.

The rental company has notified me of a fine, can I obtain a copy?

We inform you that it is not possible to forward you a copy of any sanctions before they have been notified to you.

I would like to ask for a refund for a penalty paid after realizing that the fine was not due

It is not possible to proceed with the request for reimbursement as set out in judgement No. 12899 of May 26th, 2010 of the Court of Appeal, II Civil Section.

I would like to lodge an appeal

The information on how to lodge an appeal, which we facilitate below, is indicated on the fine.

APPEALS PROCEDURE (Articles 203 and 204 bis of Legislative Decree No. 285 of 30/04/92)

If the reduced payment has not been made, the offender and the other subjects indicated in Art. 196 of Legislative Decree 285/92 may appeal:

• Within 60 days as of the date of notification to the Prefect of Milan by registered letter with acknowledgement of receipt, addressed to its headquarters in Corso Monforte 31 – 20122 Milano or to the Prefect of Milan by registered letter with acknowledgement of receipt, addressed to the Servizio di Polizia Locale della Città Metropolitana di Milano – Servizio Coordinamento Operativo – Viale Piceno 60. 20129 – Milano

• Within 30 days as of the date of notification, before the local
List of municipalities under the jurisdiction of the Justice of the Peace by handing it over directly or by registered letter with acknowledgement of receipt, pursuant to art. 7 of Legislative Decree 150/11.

If no appeal has been lodged within the given timeframe and no reduced payment has been made, this fine shall be enforceable for an amount equivalent to the half of the maximum of the administrative sanction, plus the costs of the proceedings.

I have received an “Informal notice before the forced collection”

You can, by the deadline indicated on the letter:

• pay the amounts due, as per the attached payment bulletin

• provide the proof of payment within the date indicated on the letter.

ABROAD

• pay the amounts due

• provide the proof of payment within the date indicated on the letter.

I have received an “Informal notice before the forced collection”: what happens if I do not pay it or if I pay it partially?

I have received an “Informal notice before the forced collection”: how was the amount to be paid calculated?

If no appeal has been lodged within the given timeframe and no reduced payment has been made, this fine shall be enforceable for an amount equivalent to the half of the maximum of the administrative sanction, plus the costs of the proceedings.(Article 203, paragraph 3 of the Traffic Code).

You should pay, within 30 days of notification, as follows:

• by paying a deposit to the account number 001016309856 in the name of CITTA’ METROPOLITANA DI MILANO RISCOSS. COATT. SANCTIONS RELEV. VEL. SERV. TES., indicating in the reason for payment “Ingiunzione n. … .. “

• by bank transfer made out to CITTA’ METROPOLITANA DI MILANO RISCOSS. COATT. SANCTIONS RELEV. VEL. SERV. TES. to the IBAN coordinates: IT87O0760101600001016309856 indicating in the reason for payment “Ingiunzione N. …. “

I have received a tax injunction: what actions can I take?

Why is it not indicated whether it is an instant speed (speed camera) or average speed (tutor) detection?

The legislation provides that the warning signs bear only the words “electronic speed control”, namely ” electronic speed detection”, regardless of the type of detector used (legislative reference to article 1, point 2 of the Decree of the Ministry of the Interior of August 15th, 2007).
